On April 26, 2016 at 4:00 P.M., The Bergen County Utilities Authority, the agency responsible for the implementation of the Bergen County Solid Waste Management Plan, as amended, shall hold a public hearing relating to a proposed amendment to the Bergen County District Solid Waste Management Plan to incorporate the Prospect Heights Care Center SteriMed System 70 Medical Waste Treatment Unit located at Lot 10, Block 341, 336 Prospect Avenue, Hackensack, New Jersey, 07601 into the Bergen County District Solid Waste Management Plan.

The hearing shall be held at The Bergen County Utilities Authority, Administration Building, Foot of Mehrhof Road, Little Ferry, New Jersey, at 4:00 P.M. in the Public Meeting Room. A draft copy of the proposed Amendment will be available after March 22, 2016, at The Bergen County Utilities Authority Administration Building, Foot of Mehrhof Road, Little Ferry, New Jersey; posted on The Bergen County Utilities Authority web site at www.bcua.org; and delivered to the Office of the Clerk to the Bergen County Board of Chosen Freeholders, Court Plaza South, 21 Main Street, Hackensack, New Jersey; and with the Borough Clerk of each municipality in the County of Bergen.

On prior occasion, the Bergen County Utilities Authority conducted a public hearing regarding the subject Amendment. Subsequent to the public hearing and the Bergen County Utilities Authority recommendation to the Bergen County Board of Chosen Freeholders, the BergenCounty Board of Chosen Freeholders adopted Resolution 112-16 remanding the Plan Amendment back to the Bergen County Utilities Authority for further clarification. The public hearing shall include but not be limited to further fact finding and clarification regarding the following as it pertains to the Prospect Heights Care Center SteriMed System 70 Medical Waste Treatment Unit proposed Plan Amendment:

• Determine if the sterilization methods utilized in the SteriMed System 70 Medical Waste Treatment Unit provides for the destruction of all pathogens and germs inherent in regulated medical waste.
• Determine whether there are any SteriMed System 70 Medical Waste Treatment Units being utilized in the United States in the same manner as contemplated in the Bergen County Solid Waste Management Plan Amendment.
• Determine what type of controls would be implemented by Prospect Heights Care Center to ensure that 1) the regulated medical waste is handled properly and to 2) that only waste generated by patients of Prospect Heights Care Center is to be introduced into the SteriMed System 70 Medical Waste Treatment Unit. Determine the regulatory agency responsible to enforce the laws, rules, regulations or codes regarding the proposed SteriMed System 70 Medical Waste Treatment Unit.
• Determine whether the effluent generated by the SteriMed System 70 Medical Waste Treatment Unit is treated prior to discharge into the sanitary sewer system and what methods are incorporated to ensure that pathogens and germs are not discharged into the local sanitary sewer system.

The Bergen County Utilities Authority shall hear all persons interested in the proposed Solid Waste Management Plan Amendment and shall consider any and all comments or written objections that may be filed and any evidence which may be introduced in support of the objection, or any opposition to the adoption of the Solid Waste Management Plan Amendment, for the Bergen County Solid Waste Management District.

The Bergen County Utilities Authority h.as requested that, ten (10) days prior to the hearing, the Applicant submit further information regarding the issues identified by the Bergen County Board of Chosen Freeholders and enumerated above. Any such additional information submitted by the Applicant will be made available to the public upon receipt.
