NOTICE TO PROPOSERS
REQUEST FOR PROPOSALS FOR A SOLAR CONCESSION AND POWER PURCHASE AGREEMENT FOR MULTIPLE SOLAR PHOTOVOLTAIC SYSTEMS AT VARIOUS CITY OF HACKENSACK SITES
The CITY OF HACKENSACK is soliciting proposals to perform or furnish the following services: a solar concession and power purchase agreement for four (4) City of Hackensack sites: three (3) rooftop sites and one (1) parking garage canopy site, totaling at least 471 kW. The services are more fully described in the proposal packets available from the City Clerk’s Office, 65 Central Avenue, 3rd Floor, Hackensack, NJ, 07601 and which are available weekdays between the hours of 9:00 a.m. to 4:00 p.m., telephone number (201) 646-3940. In order to offset the City’s costs of making the proposal packets available, prospective proposers will be required to pay a fee of $50.00 for each proposal packet requested. Checks shall be made payable to: Treasurer, CITY OF HACKENSACK, New Jersey. Proposals must be submitted in the form provided in the proposal packet.
These proposals are being solicited through the competitive contracting procurement process in accordance with N.J.S.A. 40A:11-4.1 et seq., which is a fair and open process as referred to in N.J.S.A. 19:44A-20.4 et seq. Sealed responses to these requests must be received by the City Clerk no later than 10:00 a.m. on June 2, 2011. The proposal for a Solar Concession and Power Purchase Agreement for Multiple Solar Photovoltaic Systems at Various City of Hackensack Sites opening will take place at the City Clerk’s Office on June the Second 2011 at 10 a.m. The Director of Purchasing will publicly open and read the name and proposed fee for all of the Proposals received. Prior to 10:00 a.m. on the morning of June 2, 2011, proposals must be delivered to the CITY OF HACKENSACK, City Clerk’s Office, 65 Central Avenue, Hackensack, NJ 07601, to the attention of Debra Heck, City Clerk. Proposals that are not received by 10:00 a.m. at the City Clerk’s Office at 65 Central Avenue 3rd Floor will be rejected. The envelope containing a proposal shall be plainly marked on the outside of the sealed envelope to show the services for which the proposal is submitted, i.e. (Name of Proposal) as listed above.
All contracts will be awarded by the City at a public meeting(s), pursuant to a fair and open process and in accordance with the criteria set forth in this Request for Proposals and in accordance with applicable laws.
Persons awarded a contract under these procedures are required to comply with the requirements of the Equal Employment Opportunity Laws and Regulations, Americans With Disabilities Act of 1990, P.L. 2004, C19. “The New Jersey Local Unit Pay-to-Play” Law (N.J.S.A. 19:44-A-20.4 et seq.) and New Jersey Campaign Contributions and Expenditure Reporting Act (N.J.S.A. 19:44A-1 et seq.); and the Prevailing Wage Act, (N.J.S.A. 34:11-56.25 et seq.).
A pre-proposal meeting will be held at 65 Central Avenue, Hackensack, NJ 07601 on May 12, 2011 at 10:00 a.m. While attendance at the pre-proposal meeting is not mandatory, it is highly encouraged. Proposers will also be required to inspect the roof surfaces and building structures of the Designated Facilities prior to submitting a Proposal.

The Purchasing Agent is ADVERTISING ADDENDUM #1 IS ISSUED FOR THE PURPOSE OF REQUESTING AN OPTIONAL ADDITIONAL PPA PRICE TO BE INCLUDED IN THE PROPOSAL DUE JUNE 2, 2011 at 10:00am, IN ADDITION TO THE BASE PPA PRICE REQUESTED PER THE RFP, THE CITY REQUESTS THAT PROPOSERS INCLUDE A SECONDARY OPTIONAL PPA PRCIE TO INCLUDE THE COST OF ROOF REPLACEMENT AT THE FACILITIES OUTLINED IN THE RFP, EXCLUDING THE PARKIMG STRUCTURE.
Addendum #1 can be picked up at the City of Hackensack, City Clerks Office, at 65 Central Avenue, Hackensack, New Jersey, from the hours of 9:00am to 4:00pm except for holidays, Saturdays and Sundays.

Clarification on Roof Types:
The Fire Department and M&M Recreation Buildings have built-up, multi-ply hot roof system type roofs.
The DPW building roof is a Sarnifil membrane type roof.

1Q: Is a Proposal Bond required for this project?
1A: Yes, per the RFP the Proposal Bond amount is $20,000.
2Q: What is the duration of the Performance Bond requirement?
2A: The Performance Bond shall remain in place until the Company achieves the Commercial Operations
Date of the last Designated Facility.
3Q: Would the City be tax-exempt for the costs of roof replacement on its facilities?
4Q: Can value-added options, pricing structures or services be included the Proposals?
4A: Yes, value-added options not specifically requested in the RFP may be included in the RFP. Proposers
should include these options as alternative options in addition to the base pricing requested in the RFP.
